Terms, Conditions & Privacy Policy
Last updated: August 7, 2026
This page contains two documents. Part One is our Website & Applications Terms — the rules that apply when you use our website or any Smart Foundation Repair application. Part Two is our Privacy Policy — what personal information we collect, why, who we share it with, and the choices you have.
Smart Foundation Repair provides foundation repair, house leveling, waterproofing, drainage and crawl space services in the Kansas City and Dallas areas.
Part One — Website & Applications Terms
Effective date: August 7, 2026
Please read these Terms carefully before using the website and applications provided by Smart Foundation Repair (“Smart Foundation Repair,” “Company,” “we,” “our,” or “us”). By accessing or using our website or applications (together, the “Services”), you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
1. What these Terms cover — and what they do not
These Terms govern your use of our website and our applications.
They do not govern the work we do for you. Any inspection, estimate, repair or other work is governed by the written contract or proposal you sign with us, together with the warranty document we issue. If anything in these Terms appears to conflict with that contract, the contract governs the work, and nothing on this page limits, reduces or replaces your rights under it — including your warranty rights.
2. Acceptance of Terms
By using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms form a legally binding agreement between you and Smart Foundation Repair.
3. Changes to these Terms
We may modify these Terms at any time. Changes take effect when posted on this page, and the “Effective date” above tells you when they last changed. Your continued use of the Services after a change means you accept the updated Terms. Changes to these Terms do not affect a signed contract for work already underway.
4. Your privacy
How we collect, use and protect your personal information is set out in Part Two of this page, below. Please read it — by using the Services you also agree to the practices it describes.
5. Requesting an inspection or quote
You can ask us for a free inspection through our website, by phone, or through a third-party platform we work with.
Submitting a request is not a contract. It is an enquiry. We will contact you to arrange a visit, and any work only goes ahead once you have a written estimate and you accept it.
When you submit a request, you agree to give us accurate contact and property information, and you confirm that you either own the property or have the owner’s permission to arrange an inspection of it.
6. Accounts
Some customers, employees, vendors and subcontractors have accounts in our applications.
- Give accurate, current and complete information when you register, and keep it up to date.
- Keep your sign-in details confidential. You are responsible for activity under your account. Tell us promptly if you believe someone else has used it.
- Use your account only for its intended purpose, and only to access information you are authorised to see.
- We may suspend or close an account at our discretion — including where an account is misused, where these Terms are breached, or where the relationship the account exists to support has ended.
7. Text messages
If you give us your phone number, you agree to receive text messages from us about your enquiry, appointment reminders and other updates. Message and data rates may apply. Reply STOP to any message to stop receiving them. Full detail is in Part Two.
8. Acceptable use
When using the Services, please do not:
- Use them for any unlawful purpose, or to harass, defraud or impersonate anyone
- Interfere with, disrupt, overload or attempt to gain unauthorised access to the Services or any system or network connected to them
- Scrape, harvest or systematically collect data from the Services
- Upload anything containing malware, or anything unlawful, defamatory or infringing
- Misrepresent your identity or your authority over a property
9. Our content
The content of the Services — text, images, photographs, video, logos, designs, and the Smart Foundation Repair name and marks — belongs to us or our licensors and is protected by law. You may view and share our content for personal, non-commercial purposes. Any other use, including copying, reproduction or commercial use, needs our written permission.
10. Information on the Services
We work to keep our information accurate, but the Services are provided for general information only.
- Prices, availability, service areas and content can change without notice. Nothing on the Services is an offer, a quotation, or a guarantee of price or availability.
- Descriptions of services, methods and typical outcomes are general and are not a promise about your property. Only a written estimate for your property is specific to you.
- Nothing on the Services is engineering, legal or financial advice.
11. Reviews, feedback and submissions
If you post a review, send us feedback, or submit photographs or other content through the Services, you give us permission to use, reproduce and display it in connection with our business, including in marketing — with your first name and general location. Please only submit content you have the right to share. We may remove anything at our discretion.
12. Third-party links and platforms
The Services link to websites and platforms we do not control — including lead and home-services platforms, lenders, review sites and social media. We are not responsible for their content, their practices, or what they do with information you give them. Their terms and privacy policies apply, not ours.
13. Disclaimer
To the fullest extent the law allows, the Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
This disclaimer applies to the website and applications only. It does not apply to the work we perform for you, which is covered by your signed contract and warranty.
14. Limitation of liability
To the fullest extent the law allows, Smart Foundation Repair is not liable for any indirect, incidental, special or consequential damages arising out of your use of the website or applications, and our total liability arising out of the Services is limited to one hundred dollars ($100).
This limitation applies to the website and applications only. It does not apply to, limit or reduce our liability under any contract for work, under any warranty we issue, or for anything that cannot lawfully be limited — including death or personal injury caused by our negligence, and fraud.
15. Termination
We may suspend or end your access to the Services at our discretion, with or without notice, including for breach of these Terms. Sections that by their nature should survive — including sections 9, 13, 14 and 16 — continue to apply after that.
16. Governing law
These Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws rules, and any dispute about the Services will be brought in the state or federal courts serving Clay County, Missouri.
Nothing in these Terms removes any right you have under consumer protection law that cannot be waived.
17. Contact
Questions about these Terms — see the contact details at the bottom of this page.
Part Two — Privacy Policy
Last updated: August 7, 2026
This policy explains what personal information we collect, why we collect it, who we share it with, and the choices you have.
It applies to our website at smartfoundationrepair.com (and fixitforever.com, which forwards here), to the software applications we use to run our business, and to the phone, text and email conversations we have with you.
The short version
- We collect what we need to give you a quote, do the work, and keep in touch about it.
- We do not sell your personal information.
- If you give us your phone number, we may text you — and you can stop that any time by replying STOP.
- Our website uses Google Analytics, which sets cookies to tell us how the site is used.
- You can ask us what we hold about you, ask us to correct it, or ask us to delete it.
Information we collect
When you contact us
Our contact form asks for your first and last name, email address, phone number, which metro area you are in, and which services you are interested in. If you call us instead, we collect whatever you choose to tell us — typically the same things, plus details about your property and the problem you are describing.
When a lead service sends you to us
We work with third-party home-services and advertising platforms. When you request a quote through one of them, that platform sends us your contact details and the details of your request. What they collect from you, and what they do with it themselves, is governed by their privacy policies, not this one.
When we do work for you
To quote, schedule and complete a job we collect and keep records such as your property address, details and photographs of the property and the conditions we find, the work performed, appointment history, warranty information, invoices and payment records, and our notes and correspondence with you.
If you apply for financing through a lender we work with, you deal with that lender directly and they handle your financial details under their own policy. We receive only what we need to schedule and complete your job.
When you sign in to one of our applications
Some customers, employees and vendors have accounts in the software we use to run the business. Sign-in is handled by Clerk, an identity provider, and you may choose to sign in with a Google account. When you do, we receive your name and email address and, if you use Google, confirmation from Google that you signed in successfully. We never receive or store your Google password.
Employee accounts also carry the employment-related information you would expect an employer to hold. Vendor and subcontractor accounts carry business contact details and records of the work your company performs for us.
When you visit our website
We use Google Analytics, delivered through Google Tag Manager, which places cookies in your browser and records things like the pages you visit, roughly where you are (city level), which site or advert you arrived from, and what browser and device you are using. This tells us which pages are useful and which adverts work. We may use similar analytics or advertising tools from other providers for the same purpose.
How we use your information
- To respond to your enquiry and give you a quote
- To schedule, perform, inspect and warranty the work
- To take payment and keep the records a contractor is required to keep
- To send appointment reminders and updates about your job
- To tell you about services, offers and seasonal maintenance, where you have agreed to hear from us
- To run, secure and improve our website and our internal software
- To meet our legal, tax, insurance and licensing obligations, and to establish or defend legal claims
Calls and text messages
If you give us your phone number, you agree to receive text messages from Smart Foundation Repair about your enquiry, appointment reminders and other updates. Message and data rates may apply. Message frequency varies.
Reply STOP to any message to stop receiving them. Reply HELP for help. Stopping marketing or reminder messages does not stop us contacting you about work already in progress.
We may also call you about your enquiry or your job, and calls may be recorded or monitored for quality and training. If a call is being recorded you will be told at the start of the call.
We do not share your phone number with third parties for their own marketing.
Who we share information with
We share personal information only as described here:
- Companies that work for us — scheduling and dispatch software, our identity and sign-in provider, website hosting and analytics providers, payment processors, email and text message providers, and similar service providers. They may only use it to provide that service to us.
- Subcontractors and trade partners who perform or assist with part of your job, and only the details they need to do it.
- Lenders and finance partners, where you have asked us to help arrange financing.
- Professional advisers, insurers and regulators, where we are required or reasonably need to share.
- Law enforcement or others, where the law requires it, or to protect the rights, property or safety of our customers, our staff or the public.
- A buyer or successor, if our business or part of it is sold or reorganised.
We do not sell your personal information, and we do not share it for cross-context behavioural advertising in exchange for payment.
Cookies and your choices about tracking
Cookies are small files a website stores in your browser. Ours are used to make the site work and to measure how it is used.
You can control cookies through your browser settings — every major browser lets you block or delete them, though some parts of the site may not work as well if you do. You can also opt out of Google Analytics specifically using Google’s browser add-on at https://tools.google.com/dlpage/gaoptout.
Our site does not currently respond to “Do Not Track” browser signals, because there is no common standard for what they mean.
How long we keep information
We keep enquiry and lead information for as long as we are reasonably following it up, and customer job records for as long as we may need them — for warranty, insurance, licensing, tax and legal reasons. Warranty records are kept for at least the life of the warranty. Employee and vendor records are kept for as long as the relationship lasts and for as long as the law requires afterwards. When we no longer need information, we delete it or make it anonymous.
Your rights
Whatever state you live in, you can ask us to:
- Tell you what personal information we hold about you and give you a copy
- Correct anything that is wrong
- Delete what we hold, unless we are required to keep it (for example, records tied to a warranty, a contract, or a tax or licensing obligation)
- Stop marketing to you, at any time
To make a request, contact us using the details below. We will confirm who you are before we act, so that we do not give your information to someone else. We will respond within 45 days, and will tell you if we need longer.
We will not treat you differently for exercising any of these rights.
If you are a Texas resident
The Texas Data Privacy and Security Act gives Texas residents the rights listed above, plus the right to obtain your information in a portable form, and the right to opt out of targeted advertising, of the sale of personal data, and of profiling used to make significant decisions about you.
We do not sell personal data, and we do not use profiling to make decisions about you. If you want to opt out of targeted advertising, contact us using the details below.
If we refuse a request, you may appeal by replying to our decision. If we deny your appeal, you may complain to the Texas Attorney General at https://www.texasattorneygeneral.gov.
Security
We protect personal information with measures appropriate to how sensitive it is — including requiring sign-in for our internal applications, limiting access to staff who need it, and using encrypted connections. No system is perfectly secure, and we cannot guarantee absolute security, but we take this seriously and we act promptly if something goes wrong.
Children
Our services and our website are meant for adults. We do not knowingly collect personal information from children under 13. If you believe a child has given us information, contact us and we will delete it.
Links to other sites
Our website and messages may link to sites we do not control, including lead platforms, lenders and social media. This policy does not cover them. Please read their policies before giving them your information.
Changes to this policy
If we change this policy we will post the new version here and update the “Last updated” date at the top. If the change is significant, we will make that clear.
